Federal Judge Halts Joe Biden Plan For Undocumented Spouses

Judge Campbell Parker, a United States District Court Judge has ruled against President Joe Biden’s plan to create a pathway to United States citizenship for undocumented immigrants who are married to American citizens.

Judge Parker who is an appointee of Donald Trump during his last administration said that President Joe Biden administration lacked the power to make such decisions to enact the programme.

Judge Campbell Parker supported a filed lawsuit which was brought by 16 Republican states that kicked against the Biden administration not being able to bypass the Congress to pass the immigration legislation.

Hundreds of thousands of undocumented immigrants have been blocked by Judge Barker a few days after the program started in August.

In August the Biden administration announced the Keeping Families Together programme, which will give undocumented immigrants married to United States citizens living in the country for a decade or more a chance of getting a green card without leaving the United States. 

The program will allow residents with green cards who are married to United States citizens to be able to apply for citizenship after three years.

The White House was dissatisfied with the ruling of Judge Campbell Parker and in a statement by Angelo Fernández Hernández, the White House Spokesman said “This ruling sides with Republican state officials who are seeking to force US citizens and their families, people who have lived in the United States for more than ten years, to either separate or live in the shadows in constant fear of deportation”.

He further added that “Our Administration believes in keeping American families together,” and that the Biden administration is looking at all possible solutions to overturn the decision in the Supreme Court.

Gene Hamilton, the executive director of Homeland Security said that he was highly disappointed by the ruling, he added that “We firmly believe Keeping Families Together is grounded in well-established legal authority, and its purpose is consistent with fundamental American values.”

Gene further pointed out that “Since day one, the Biden-Harris Administration has dedicated itself to the decimation of our immigration system and the erasure of our borders”.

The administration has planned to appeal Judge Barker’s ruling, but with the emergence of Donald Trump as the new president the hopes of appealing the ruling have been dashed as the newly elected president has already announced that his administration will carry out the biggest deportation in America history.
